OTOH, the author could claim to have developed the patch on a GPLv2+
tree, which makes the patch GPLv2+ too, and it would be very difficult
for anyone to prove such a claim wrong.

When such a patch is applied to a GPLv3+ tree, the result is GPLv3+,
but this doesn't change the copyright status of the patch itself.
