Possible GPL infringment in the HighTec GNU compiler

Hitex is a company that sells development tools for embedded platforms. One of 
those products is C compiler called "HighTec GNU compiler" for the C166 
processor, which is a GCC ported to the new target..

In their august 2003 newsletter, they claimed that the HighTec GNU compiler is 
not covered by the GPL, and that people are not allowed to request the 
sources or to copy the product.

I'm not an expert, but it looks to me as a GPL infringment. The newsletter can
