fork: permission denied with new 3.1.1 compiler (not present with 3.0.3) and cygwin

cygwin + gcc 3.1.1 issue

We previously used 3.0.3 and had no issues
I have rebuilt the tool chain from 3.1.1 for our platform
(mips-wrs-vxworks) on i686-pc-cygwin
and now periodically get 
fork: permission denied

its probably more of a cygwin issue,
but I was curious if anyone else has seen this behaviour change 
with 3.1 or 3.1.1 or 3.2
