Confirmed. Reduced testcase:

===========================
char foo(unsigned n)
{
    char c[1][n];
    return c[0][0];
}
===========================

The ICE appeared with gcc 4.0.0.
The code compiles fine if one replaces unsigned with int, or char with int.
