If so I truly wonder why.

The gcc 3.2.2 and 3.2.3 releases didn't have that patch merged nor does
current CVS.  Unfortunately all those versions still do produce wrong code
and unbootable ARM Linux kernels.  And this problem appears to affect other
ARM targets than just XScale as well.

Is there someone from the gcc team who can explain why that fix still hasn't 
been merged after 5 months and 2 official releases have passed?
