In baby Frenglish with a baby mind, my understanding of the recent
"exception" fiasco is that you can, but you'll force anybody linking
her/his code to libgfortran to make their sources public. Since this
will hurt more gnu projects than anybody else, the libraries are under
a less restrictive licence that allows, under conditions I have not
fully understood, to link with the libs without having to disclose
the sources if you cannot or don't want to do it.

At least it is what I have understood. You may have a look to the leading
comments in gcc/fortran/bbt.c and compare it to those in the ligfortran
sources.
