Indeed.  I think I was somewhat unclear -- what I was trying to make was 
a distinction between "your code may become free software without your 
consent" and "you may find yourself in a position where you'd prefer to 
choose to make your code free software rather than paying court-imposed 
damages and disentangling it from the GPL-licensed things that it's 
based on."  And, as you point out, a number of companies have found 
themselves in such a position and made out-of-court settlements.

(I'd take this to misc.gnu.discuss, but I think I'd rather not spend 
that much time on it, if that's ok with you.)
