I can't disagree with that. But it seems that the FSF has been
attempting to avoiding the risk of having to go to court with a
contentious legal opinion.
It's actually the other way around. Since many attorneys donate their
services to the FSF, they have little to lose by doing so.
The people who would have the most to lose would be companies that have
obtained funding based on doing something that's legally contentious. If
they went the IPO route, for example, they'd have to disclose that it
was contentious, which would make it very hard to raise money.
